1. Acceptance of Terms

These Terms of Use (“Terms”) govern your access to and use of the HeartsBridge platform operated by FosterAll (“we,” “us,” or “our”). By accessing or using HeartsBridge, you agree to be bound by these Terms. If you do not agree, please do not use the platform.

2. Platform Purpose

HeartsBridge is a community platform that connects foster and kinship families with donors who provide specific items directly. We facilitate the connection between families in need and community members willing to help. HeartsBridge is not a marketplace, retailer, or payment processor. No money changes hands through our platform — donors purchase and deliver items directly to families.

3. Eligibility

You must be at least 18 years of age to create an account or make a commitment on HeartsBridge. By using the platform, you represent that you meet this requirement.

4. Accounts

Some features require an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate information and to notify us promptly if you suspect unauthorized use of your account.

5. Commitments & Donations

When you commit to fulfilling a need listed on HeartsBridge, you agree to make a good-faith effort to provide the specified item within a reasonable timeframe. We understand that circumstances change — if you can no longer fulfill a commitment, please notify us as soon as possible so another donor can step in.

HeartsBridge does not guarantee the fulfillment of any listed need. We are a facilitator, not a party to the donation itself.

6. Acceptable Use

You agree not to:

• Use the platform for any unlawful purpose or in violation of any applicable laws.
• Attempt to identify, contact, or share personal information about foster or kinship families beyond what is necessary to coordinate a donation.
• Post or transmit false, misleading, or fraudulent information.
• Interfere with or disrupt the platform or its infrastructure.
• Scrape, harvest, or collect data from the platform using automated means.
• Use information obtained through HeartsBridge for marketing, solicitation, or any purpose unrelated to fulfilling a need.

7. Family Privacy & Confidentiality

Protecting the privacy of foster and kinship families is paramount. Any identifying information you receive through the donation process (names, addresses, phone numbers) must be kept strictly confidential and used only for the purpose of completing your donation. Sharing or distributing this information is a violation of these Terms and may result in immediate account termination.

8. Intellectual Property

All content on HeartsBridge — including text, graphics, logos, and software — is owned by or licensed to FosterAll and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without prior written permission.

9. Disclaimer of Warranties

HeartsBridge is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. We do not warrant that the platform will be uninterrupted, error-free, or secure. We do not endorse or guarantee the quality, safety, or suitability of any donated items.

10. Limitation of Liability

To the fullest extent permitted by law, FosterAll and its officers, directors, employees, and volunteers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of HeartsBridge, including but not limited to damages related to donated items, personal interactions, or any actions taken based on information obtained through the platform.

11. Indemnification

You agree to indemnify and hold harmless FosterAll and its team from any claims, losses, or damages (including reasonable attorney's fees) arising from your use of the platform, your violation of these Terms, or your violation of any third-party rights.

12. Termination

We reserve the right to suspend or terminate your access to HeartsBridge at any time, with or without notice, for conduct that we determine violates these Terms or is harmful to other users, families, or the platform.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Santa Barbara County, California.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify users via email or a prominent notice on the platform. Your continued use of HeartsBridge after changes are posted constitutes acceptance of the updated Terms.
